Alternative dispute resolution 


1. The consumer has the right to contact the operator with a request for remedy (in writing at the operator's address or by e-mail to: reception@arkadyhof.sk) if they are not satisfied with the way in which the operator has handled their complaint or if they believe that the operator has violated their rights. If the operator responds to this request in a negative manner or fails to respond within 30 days of it being sent, the consumer has the right to submit an application for the initiation of an alternative dispute resolution to a body under Act 391/2015 Coll. on alternative dispute resolution. According to Act 391/2015 Coll. alternative dispute resolution bodies are authorities and legal entities. The consumer has the right to choose between alternative dispute resolution bodies. The consumer may submit the application in a manner guaranteed under Section 12 of Act No. 391/2015 Coll. 


 2. The list of alternative dispute resolution bodies (hereinafter as ADR bodies) can be found on the website of the Ministry of Economy of the Slovak Republic. An ADR body is an independent, impartial body that carries out independent, impartial, transparent, efficient, fast and fair alternative dispute resolution procedures for consumer disputes. Other important information on ADR for consumers is also published on the above website. 


 3. Alternative dispute resolution does not apply to disputes where the value of the dispute does not exceed EUR 20. The application for the initiation of ADR shall be submitted to the ADR body pursuant to the provision of Section 3 of the above-mentioned Act, using a designated platform or form. The ADR body may require the consumer to pay a fee for the initiation of ADR, up to a maximum of EUR 5 including VAT. In addition to ADR, the consumer has a right to apply to the general or arbitration court with jurisdiction in the matter and place.
